1 1 Section 1. Section 249A.3, Code Supplement 2001, is
1 2 amended by adding the following new subsection:
1 3 NEW SUBSECTION. 14. In determining the eligibility of an
1 4 individual for medical assistance, the department shall also
1 5 determine and document the individual's eligibility for
1 6 benefits from the United States veterans administration.
1 7 Sec. 2. Section 331.439, subsection 1, paragraph c,
1 8 subparagraph (2), subparagraph subdivision (a), Code 2001, is
1 9 amended to read as follows:
1 10 (a) The enrollment and eligibility process, which shall
1 11 include but is not limited to determination and documentation
1 12 of each person's eligibility for benefits from the United
1 13 States veterans administration.
1 14 Sec. 3. Section 356.5, Code 2001, is amended by adding the
1 15 following new subsection:
1 16 NEW SUBSECTION. 7. Ensure that each prisoner's
1 17 eligibility for benefits from the United States veterans
1 18 administration is determined and is documented in the
1 19 prisoner's record.
1 20 Sec. 4. NEW SECTION. 904.517 ELIGIBILITY FOR VETERANS
1 21 BENEFITS.
1 22 Eligibility for benefits from the United States veterans
1 23 administration shall be determined for each person committed
1 24 to the custody of the director, and the eligibility status
1 25 shall be documented in the person's record under section
1 26 904.601.
1 27 EXPLANATION
1 28 This bill requires that eligibility determinations for
1 29 benefits available from the United States veterans
1 30 administration be made under the following circumstances:
1 31 under Code chapter 249A for medical assistance eligibility
1 32 determinations, for the eligibility process under county
1 33 mental health services management plans approved pursuant to
1 34 Code section 331.439, under Code chapter 356 for prisoners of
1 35 jails and municipal holding facilities, and under Code chapter
2 1 904 for inmates committed to the custody of the director of
2 2 the department of corrections in a correctional facility. In
2 3 many of the provisions, the entity performing the eligibility
2 4 determination must also document the determination.
