  1  4 RELATING TO THE PROCEDURAL REQUIREMENTS FOR FOREIGN AND
  1  5    INTERNATIONAL ADOPTION AND PROVIDING AN EFFECTIVE DATE.

  1  7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  8 
  1  9    Section 1.  Section 144.23, subsection 3, unnumbered
  1 10 paragraph 2, Code 2001, is amended by striking the unnumbered
  1 11 paragraph.
  1 12    Sec. 2.  NEW SECTION.  144.25A  CERTIFICATE OF BIRTH –
  1 13 FOREIGN AND INTERNATIONAL ADOPTIONS.
  1 14    The department shall adopt rules pursuant to chapter 17A to
  1 15 establish a procedure for the issuance of a certificate of
  1 16 birth for children adopted pursuant to section 600.15.
  1 17    Sec. 3.  Section 600.13, subsection 5, Code Supplement
  1 18 2001, is amended to read as follows:
  1 19    5.  An interlocutory or a final adoption decree shall be
  1 20 entered with the clerk of court.  Such decree shall set forth
  1 21 any facts of the adoption petition which have been proven to
  1 22 the satisfaction of the juvenile court or court and any other
  1 23 facts considered to be relevant by the juvenile court or court
  1 24 and shall grant the adoption petition.  If so designated in
  1 25 the adoption decree, the name of the adopted person shall be
  1 26 changed by issuance of that decree.  The clerk of the court
  1 27 shall, within thirty days of issuance, deliver one certified
  1 28 copy of any adoption decree to the petitioner, one copy of any
  1 29 adoption decree to the department and any agency or person
  1 30 making an independent placement who placed a minor person for
  1 31 adoption, and one certification of adoption as prescribed in
  1 32 section 144.19 to the state registrar of vital statistics.
  1 33 Upon receipt of the certification, the state registrar shall
  1 34 prepare a new birth certificate pursuant to section 144.23 and
  1 35 deliver to the parents named in the decree and any adult
  2  1 person adopted by the decree a copy of the new birth
  2  2 certificate.  The parents shall pay the fee prescribed in
  2  3 section 144.46.  If the person adopted was born outside the
  2  4 this state but in the United States, the state registrar shall
  2  5 forward the certification of adoption to the appropriate
  2  6 agency in the state or foreign nation of birth.  A copy of any
  2  7 interlocutory adoption decree vacation shall be delivered and
  2  8 another birth certificate shall be prepared in the same manner
  2  9 as a certification of adoption is delivered and the birth
  2 10 certificate was originally prepared.
  2 11    Sec. 4.  Section 600.15, Code Supplement 2001, is amended
  2 12 to read as follows:
  2 13    600.15  FOREIGN AND INTERNATIONAL ADOPTIONS.
  2 14    1.  a.  A decree establishing a parent-child relationship
  2 15 by adoption which is issued pursuant to due process of law by
  2 16 a juvenile court or court of any other jurisdiction in within
  2 17 or outside the United States shall be recognized in this
  2 18 state.
  2 19    b.  A decree terminating a parent-child relationship which
  2 20 is issued pursuant to due process of law by a juvenile court
  2 21 or court of any other jurisdiction in the United States shall
  2 22 be recognized in this state.
  2 23    c.  Documentation demonstrating that a child has been
  2 24 legally released or approved for adoption by the child's
  2 25 country of origin shall be accepted as evidence that
  2 26 termination of parental rights has been completed in that
  2 27 country and shall be recognized in this state.
  2 28    2.  If an adoption has occurred in the minor person's
  2 29 country of origin, a further adoption must occur in the state
  2 30 where the adopting parents reside in accordance with the
  2 31 adoption laws of that state.
  2 32    3.  A licensed child-placing agency as defined in section
  2 33 238.2, a person making an independent placement as defined in
  2 34 section 600A.2, or an investigator may provide necessary
  2 35 assistance to an eligible citizen of Iowa who desires to, in
  3  1 accordance with the immigration laws of the United States,
  3  2 make an international adoption.
  3  3    Sec. 5.  EFFECTIVE DATE.  This Act, being deemed of
  3  4 immediate importance, takes effect upon enactment.
