1 1 Section 1. NEW SECTION. 155A.40 CONTINUOUS QUALITY
1 2 IMPROVEMENT PROGRAM.
1 3 1. Each licensed pharmacy shall implement a continuous
1 4 quality improvement program to review pharmacy procedures in
1 5 order to identify methods for addressing pharmacy medication
1 6 errors and for improving patient use of medications and
1 7 patient care services. Under the program, each pharmacy shall
1 8 assess its practices and identify areas for quality
1 9 improvement. The program shall comply with rules adopted by
1 10 the board.
1 11 2. The board shall adopt rules for the administration of
1 12 the continuous quality improvement program. The rules shall
1 13 address all of the following:
1 14 a. Program requirements and procedures.
1 15 b. Program record and reporting requirements.
1 16 c. Any other provisions necessary for the administration
1 17 of the program.
1 18 3. Any record or reports generated solely for and
1 19 maintained by a pharmacy as a component of the pharmacy's
1 20 continuous quality improvement program shall not be subject to
1 21 discovery in any civil proceeding. However, this subsection
1 22 shall not be interpreted to prohibit the board or other
1 23 authorized government agency from reviewing or having access
1 24 to the records or reports as necessary to protect the public
1 25 health and safety.
1 26 EXPLANATION
1 27 This bill requires each licensed pharmacy to implement a
1 28 continuous quality improvement program to review pharmacy
1 29 procedures in order to identify methods for addressing
1 30 medication errors and for improving patient use of medications
1 31 and patient care services. Under the program, each pharmacy
1 32 is to assess its practices and identify areas for quality
1 33 improvement. The program is required to comply with rules
1 34 adopted by the board that include program requirements and
1 35 procedures, program record and reporting requirements and
2 1 other provisions necessary for the administration of the
2 2 program. The bill provides that records and reports generated
2 3 solely for and maintained by a pharmacy as a component of the
2 4 pharmacy's continuous quality improvement program are not
2 5 subject to discovery in any civil proceeding, but this
2 6 protection is not to be interpreted to prohibit the board or
2 7 other authorized government agency from reviewing or having
2 8 access to the records or reports as necessary to protect the
2 9 public health and safety.
