1 1 Section 1. NEW SECTION. 483A.28 REGISTRATION OF HUNTING
1 2 OUTFITTERS OR HUNTING GUIDES – PENALTY.
1 3 1. A person shall not engage in or be employed for any
1 4 compensation in the business of a hunting outfitter or a
1 5 hunting guide in this state unless the person is registered as
1 6 a hunting outfitter or a hunting guide with the department.
1 7 The commission shall define, by rule, the activities that
1 8 constitute hunting outfitter activities or hunting guide
1 9 activities for the purposes of this section. The rules shall
1 10 require an applicant for registration to identify the location
1 11 and acreage to be hunted and the equipment and services to be
1 12 provided by the outfitter or the guide.
1 13 2. The commission shall establish, by rule, the annual fee
1 14 for a hunting outfitter or hunting guide registration required
1 15 pursuant to this section. In determining an annual fee, the
1 16 commission shall consider the costs of providing for the
1 17 registration and administering and enforcing the provisions of
1 18 this section.
1 19 3. A violation of this section or the rules adopted
1 20 pursuant to this section is a simple misdemeanor and is
1 21 punishable as provided in section 483A.42.
1 22 EXPLANATION
1 23 This bill provides for the registration of persons engaged
1 24 in the business of a hunting outfitter or hunting guide. The
1 25 department of natural resources is directed to define what
1 26 activities constitute hunting outfitter activities or hunting
1 27 guide activities and register hunting outfitters or hunting
1 28 guides upon application and payment of an annual fee
1 29 determined by rule of the natural resource commission. An
1 30 applicant shall identify the location and acreage to be hunted
1 31 and the equipment and services to be provided by the outfitter
1 32 or the hunting guide.
1 33 A violator is guilty of a simple misdemeanor and subject to
1 34 a scheduled fine of $100 for each offense.
