  1  1    Section 1.  Section 35.1, subsection 2, paragraph b,
  1  2 subparagraph (2), Code 2001, is amended to read as follows:
  1  3    (2)  Former members of the Iowa national guard who served
  1  4 at least twenty years in the Iowa national guard after January
  1  5 28, 1973, and who were discharged under honorable conditions.
  1  6 However, a member of the Iowa national guard who was activated
  1  7 for federal duty service or who was activated for active state
  1  8 service by order of the governor at the request of the
  1  9 president of the United States, other than for training, for a
  1 10 minimum aggregate of ninety days, and was discharged under
  1 11 honorable conditions or was retired under Title X of the
  1 12 United States Code, shall be included as a veteran.
  1 13    Sec. 2.  Section 25B.2, subsection 3, does not apply to the
  1 14 benefits and property tax exemptions and credits available to
  1 15 veterans.  
  1 16                           EXPLANATION
  1 17    This bill provides that active state service served by a
  1 18 member of the Iowa national guard by the order of the governor
  1 19 at the request of the president of the United States, for
  1 20 purposes other than for training, shall be considered to meet
  1 21 the minimum aggregate of 90 days' service to qualify as a
  1 22 veteran.  The member must also be discharged under honorable
  1 23 conditions or retired under Title X of the United States Code.
  1 24 Current law provides that only a minimum aggregate of 90 days
  1 25 of federal service qualifies even though active state service
  1 26 is also federally authorized and funded.  Upon discharge under
  1 27 honorable conditions or retirement from the Iowa national
  1 28 guard with the minimum aggregate of 90 days active state
  1 29 service, the veteran and the veteran's family are eligible for
  1 30 veteran benefits including the military property tax exemption
  1 31 and credit.
  1 32    Code section 25B.2, subsection 3, relating to state funding
  1 33 of mandates does not apply to the provisions of this bill.
