PAG LIN 1 1 HOUSE FILE 2135 1 2 1 3 AN ACT 1 4 RELATING TO THE MEMBERSHIP OF THE PLANNING AND ZONING COM- 1 5 MISSION IN CERTAIN CITIES. 1 6 1 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 8 1 9 Section 1. Section 414.23, unnumbered paragraph 2, Code 1 10 2001, is amended to read as follows: 1 11 A municipality, during the time its zoning jurisdiction is 1 12 extended under this section, shall increase the size of its 1 13 planning and zoning commission and its board of adjustment 1 14 each by two members. The planning and zoning commission shall 1 15 include a member of the board of supervisors of the affected 1 16 county and a resident of the area outside the city limits over 1 17 which the zoning jurisdiction is extended. The additional 1 18 members of the board of adjustment shall be residents of the 1 19 area outside the city limits over which the zoning 1 20 jurisdiction is extended.TheyThe county supervisor and the 1 21 residents shall be appointed by the board of supervisors of 1 22 the county in which such extended area is located and for the 1 23 same terms of office and have the same rights, privileges, and 1 24 duties as other members of each ofsaidthe bodies. However, 1 25 if the extended zoning jurisdiction of a municipality extends 1 26 into an adjacent county without a county zoning ordinance, the 1 27 boards of supervisors of the affected counties, jointly, shall 1 28 appoint one of their members to the planning and zoning 1 29 commission. 1 30 Sec. 2. TRANSITION. If, on the effective date of this 1 31 Act, a vacancy does not exist in one of the two seats on the 1 32 planning and zoning commission, represented by residents of 1 33 the area outside the city limits pursuant to section 414.23, 1 34 the incumbents may serve their unexpired terms. Thereafter, 1 35 one of the two additional members of the planning and zoning 2 1 commission of a city extending its zoning jurisdiction shall 2 2 be a member of the board of supervisors of the affected county 2 3 pursuant to section 1 of this Act. 2 4 2 5 2 6 2 7 BRENT SIEGRIST 2 8 Speaker of the House 2 9 2 10 2 11 2 12 MARY E.
