PAG LIN 1 1 Section 1. Section 173.24, Code 2001, is amended to read 1 2 as follows: 1 3 173.24EXEMPTION OF STATE FAIR BY THE STATE'SPURCHASING 1 4 AND LEASING PROCEDURE EXEMPTIONS AND REQUIREMENTS. 1 5 1. Thestate fairboard is exempt from the state system of 1 6 uniform purchasing procedures. However, the board may 1 7 contract with the department of general services to purchase 1 8anyitemsthrough the state systemor services as provided by 1 9 chapter 18.TheOtherwise, the board shall adopt its own 1 10 system of uniform standards and specifications for purchasing. 1 11 2. a. As used in this subsection: 1 12 (1) "Agreement" means any contract, license, or lease in 1 13 which a vendor agrees to compensate the board for a temporary 1 14 location on the fairgrounds for purposes of conducting 1 15 business or presenting a demonstration or information. 1 16 (2) "Iowa-based establishment" means a person whose 1 17 principal place of business or operations are in this state. 1 18 (3) "Vendor" means a person who operates as a 1 19 concessionaire or exhibitor on the Iowa state fairgrounds. 1 20 b. A person shall not operate as a vendor from a location 1 21 on the Iowa state fairgrounds unless the person executes an 1 22 agreement with the board following the submission of an 1 23 application approved by the board according to requirements 1 24 established by the board. In approving applications for the 1 25 execution of agreements by persons to operate as vendors on 1 26 fairground locations during the Iowa state fair, if two 1 27 applications are substantially equal, the board shall provide 1 28 a preference to the application submitted by an Iowa-based 1 29 establishment. Two applications are "substantially equal" if 1 30 all of the following apply: 1 31 (1) The applicants are vendors who have comparable 1 32 qualifications. 1 33 (2) The applicants propose to operate equivalent types of 1 34 businesses, including by selling similar products or services, 1 35 or presenting equivalent demonstrations or information. 2 1 Sec. 2. EFFECTIVE DATE. This Act, being deemed of 2 2 immediate importance, takes effect upon enactment. 2 3 EXPLANATION 2 4 This bill amends Code section 173.24 that provides for 2 5 purchasing procedures by the Iowa state fair board. The bill 2 6 makes changes in the section to enhance its readability and 2 7 adds a new provision. The new provision imposes a requirement 2 8 that when the board selects persons as vendors on the Iowa 2 9 state fairgrounds (as either concessionaires or exhibitors), 2 10 it must make the selection based on applications for the 2 11 execution of agreements for temporary space on the 2 12 fairgrounds. The bill specifically provides that in approving 2 13 applications for the execution of agreements by persons to 2 14 operate as vendors on fairground locations during the Iowa 2 15 state fair, if two applications are substantially equal, the 2 16 board must provide a preference to the application submitted 2 17 by an Iowa based establishment. 2 18 The bill takes effect upon enactment. 2 19 LSB 5026HH 79 2 20 da/pj/5
