PAG LIN 1 1 HOUSE FILE 2075 1 2 1 3 AN ACT 1 4 RELATING TO THE REPAYMENT OF MONEYS APPROPRIATED FROM THE 1 5 ENDOWMENT FOR IOWA'S HEALTH ACCOUNT OF THE TOBACCO 1 6 SETTLEMENT TRUST FUND AND FROM THE SENIOR LIVING TRUST FUND. 1 7 1 8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 9 1 10 Section 1. Section 8.55, subsection 2, Code Supplement 1 11 2001, is amended to read as follows: 1 12 2. a. The maximum balance of the fund is the amount equal 1 13 to five percent of the adjusted revenue estimate for the 1 14 fiscal year. If the amount of moneys in the Iowa economic 1 15 emergency fund is equal to the maximum balance, moneys in 1 16 excess of this amount shall be transferred to the general 1 17 fund. 1 18 b. Notwithstanding paragraph "a", any moneys in excess of 1 19 the maximum balance in the economic emergency fund after the 1 20 distribution of the surplus in the general fund of the state 1 21 at the conclusion of the fiscal year beginning July 1, 2002, 1 22 and subsequent fiscal years, shall not be transferred to the 1 23 general fund of the state but shall be transferred to the 1 24 endowment for Iowa's health account of the tobacco settlement 1 25 trust fund. The amount transferred under this paragraph shall 1 26 not exceed the difference between forty million dollars and 1 27 the total amount transferred to the endowment for Iowa's 1 28 health account pursuant to 2001 Iowa Acts, chapter 177, 1 29 section 2, as amended by 2001 Iowa Acts, chapter 187, section 1 30 28, and previous fiscal years. 1 31 c. Notwithstanding paragraph "a", any moneys in excess of 1 32 the maximum balance in the economic emergency fund after the 1 33 distribution of the surplus in the general fund of the state 1 34 at the conclusion of each fiscal year and after the 1 35 appropriate amount has been transferred pursuant to paragraph 2 1 "b", shall not be transferred to the general fund of the state 2 2 but shall be transferred to the senior living trust fund. The 2 3 total amount transferred, in the aggregate, under this 2 4 paragraph for all fiscal years shall not exceed thirty-five 2 5 million five hundred thousand dollars. 2 6 d. Notwithstanding paragraph "a", any moneys in excess of 2 7 the maximum balance in the economic emergency fund after the 2 8 distribution of the surplus in the general fund of the state 2 9 at the conclusion of each fiscal year and after the 2 10 appropriate amount have been transferred pursuant to 2 11 paragraphs "b" and "c" shall not be transferred to the general 2 12 fund of the state but shall be transferred to the endowment 2 13 for Iowa's health account of the tobacco settlement trust 2 14 fund. The total amount transferred, in the aggregate, under 2 15 this paragraph for all fiscal years shall not exceed the 2 16 difference between fifty-one million five hundred thousand 2 17 dollars and the amounts transferred to the endowment for 2 18 Iowa's health account to repay the amounts transferred or 2 19 appropriated from the endowment for Iowa's health account in 2 20 2002 Iowa Acts, House File 2245, 2002 Iowa Acts, Senate File 2 21 2304, and 2002 Iowa Acts, Senate File 2315. 2 22 2 23 2 24 2 25 BRENT SIEGRIST 2 26 Speaker of the House 2 27 2 28 2 29 2 30 MARY E.
