1 1 Section 1. Section 350.4, Code 2001, is amended by adding
1 2 the following new subsection:
1 3 NEW SUBSECTION. 11. To accept goods and services
1 4 voluntarily offered to assist in the maintenance,
1 5 construction, or repair of infrastructure and facilities under
1 6 the jurisdiction of the board. All goods voluntarily given
1 7 shall be accepted subject to the plans and specifications of
1 8 the board and all voluntary services shall be performed under
1 9 the supervision of the board.
1 10 Sec. 2. Section 670.4, Code 2001, is amended by adding the
1 11 following new subsection:
1 12 NEW SUBSECTION. 16. Any claim based upon or arising out
1 13 of goods or services voluntarily provided to assist in the
1 14 maintenance, construction, or repair of infrastructure and
1 15 facilities under the jurisdiction of the county conservation
1 16 board.
1 17 EXPLANATION
1 18 This bill authorizes a county conservation board to accept
1 19 goods and services voluntarily offered to assist in the
1 20 maintenance or construction or repair of infrastructure and
1 21 facilities under the jurisdiction of the board. The goods
1 22 voluntarily given shall be accepted subject to the plans and
1 23 specifications of the board and all voluntary services shall
1 24 be performed under the supervision of the board.
1 25 The bill also exempts the county conservation board from
1 26 tort liability claims based upon or arising out of goods or
1 27 services voluntarily provided to assist in the maintenance,
1 28 construction, or repair of infrastructure and facilities.
