  1  1    Section 1.  Section 18.10, Code 2001, is amended to read as
  1  2 follows:
  1  3    18.10  CAPITOL BUILDINGS AND GROUNDS – RULES.
  1  4    The director shall establish, publish, and enforce rules
  1  5 regulating and restricting the use by the public of the
  1  6 capitol buildings and grounds; however, rules related to
  1  7 security in or on capitol buildings or grounds shall be
  1  8 adopted in conjunction with, and after approval by, the
  1  9 department of public safety.  The rules when established shall
  1 10 be posted in conspicuous places about the buildings and
  1 11 grounds.  Any person violating any rule, except a parking
  1 12 regulation, shall be guilty of a simple misdemeanor.
  1 13    Sec. 2.  Section 18.11, unnumbered paragraph 1, Code 2001,
  1 14 is amended to read as follows:
  1 15    The director, in conjunction with the department of public
  1 16 safety, shall establish, and publish, and enforce rules
  1 17 regulating, restricting, or prohibiting the use by state
  1 18 officials, state employees, and the public, of motor vehicle
  1 19 parking facilities at the state capitol complex.  Peace
  1 20 officer members of the department of public safety shall have
  1 21 the authority to enforce parking rules established pursuant to
  1 22 this section.  The assignment of legislative parking spaces
  1 23 shall be under the control of the legislative council.  The
  1 24 rules established by the director may establish fines for
  1 25 violations and a procedure for payment of the fines.  The
  1 26 director may order payment of a fine and enforce the order in
  1 27 the district court.
  1 28    Sec. 3.  Section 80.9, subsection 2, paragraph f, Code
  1 29 2001, is amended to read as follows:
  1 30    f.  Provide protection and security for persons and
  1 31 property on the grounds of the state capitol complex and, in
  1 32 conjunction with the department of general services, adopt
  1 33 rules relating to security on the grounds of the state capitol
  1 34 complex.  
  1 35                           EXPLANATION
  2  1    This bill relates to the powers of the department of public
  2  2 safety in regard to security on the capitol complex.
  2  3    The bill provides that the department of general services
  2  4 shall adopt, in conjunction with the department of public
  2  5 safety, rules relating to security and parking on the capitol
  2  6 complex.  The bill provides that the rules relating to
  2  7 security shall only be adopted after approval by the
  2  8 department of public safety.  The bill also provides that
  2  9 peace officer members of the department of public safety shall
  2 10 have the authority to enforce parking rules on the capitol
  2 11 complex.  Current law provides that the director of general
  2 12 services shall establish, publish, and enforce rules
  2 13 regulating and restricting the use by the public of the
  2 14 capitol buildings and grounds as well as rules regulating,
  2 15 restricting, or prohibiting the use by state officials, state
  2 16 employees, and the public of motor vehicle parking facilities
  2 17 on the capitol complex.
