1 1 Section 1. Section 321.445, Code Supplement 2001, is
1 2 amended by adding the following new subsection:
1 3 NEW SUBSECTION. 6. A person shall not ride, and an
1 4 operator shall not permit a person to ride, in the open bed of
1 5 a motor truck or in an unenclosed area of a motor vehicle on a
1 6 highway unless the person is properly seated on a seat and
1 7 wearing a properly adjusted and fastened seat belt or safety
1 8 harness that meets the requirements of subsection 1. This
1 9 subsection does not apply to a motor vehicle operated as part
1 10 of a parade, a motorcycle or motorized bicycle, a military
1 11 motor vehicle, an authorized emergency vehicle, an implement
1 12 of husbandry, or a motor vehicle used to transport hunters and
1 13 hunting dogs during hunting activities.
1 14 EXPLANATION
1 15 This bill prohibits a person from riding in the open bed of
1 16 a truck without being properly seated and wearing a seat belt.
1 17 The bill does not apply to persons who are participating in a
1 18 parade, motorcycles or motorized bicycles, a military motor
1 19 vehicle, an authorized emergency vehicle, an implement of
1 20 husbandry, or a vehicle used for hunting. A violation is
1 21 punishable as a simple misdemeanor and carries a scheduled
1 22 fine of $25.
