  1  1    Section 1.  Section 321.234A, Code Supplement 2001, is
  1  2 amended by striking the section and inserting in lieu thereof
  1  3 the following:
  1  4    321.234A  ALL-TERRAIN VEHICLES – HIGHWAY USE.
  1  5    1.  All-terrain vehicles shall be operated on a highway
  1  6 only between sunrise and sunset and only when the operation on
  1  7 the highway is incidental to the vehicle's use for
  1  8 agricultural purposes.  A person operating an all-terrain
  1  9 vehicle on a highway shall have a valid driver's license and
  1 10 the vehicle shall be operated at speeds of thirty-five miles
  1 11 per hour or less.
  1 12    2.  A person convicted of a violation of this section is
  1 13 guilty of a simple misdemeanor punishable as a scheduled
  1 14 violation under section 805.8A, subsection 3, paragraph "f".
  1 15    Sec. 2.  Section 321G.13, subsection 9, Code Supplement
  1 16 2001, is amended by striking the subsection.
  1 17    Sec. 3.  Section 805.8B, subsection 2, paragraph b, Code
  1 18 Supplement 2001, is amended to read as follows:
  1 19    b.  For operating violations under section 321G.9,
  1 20 subsections 1, 2, 3, 4, 5, and 7, sections 321G.11, and
  1 21 321G.13, subsections 4 and 9 subsection 4, the scheduled fine
  1 22 is twenty dollars.  
  1 23                           EXPLANATION
  1 24    This bill repeals the requirement that the operator of an
  1 25 all-terrain vehicle or snowmobile on a public road or street
  1 26 fly a flag or pennant on the all-terrain vehicle or
  1 27 snowmobile.
