  1  1    Section 1.  Section 455B.161, subsection 21, Code 2001, is
  1  2 amended to read as follows:
  1  3    21.  "Small animal feeding operation" means an animal
  1  4 feeding operation which has an animal weight capacity of two
  1  5 three hundred thousand pounds or less for animals other than
  1  6 bovine, or four hundred thousand pounds or less for bovine.  
  1  7                           EXPLANATION
  1  8    This bill amends Code chapter 455B that provides for the
  1  9 regulation of animal feeding operations, including confinement
  1 10 feeding operations and open feedlots.  Specifically, the
  1 11 regulations apply to separate parts of the chapter, the first
  1 12 part regulating air quality and specifically by providing for
  1 13 separation distances (see Code section 455B.162) and the
  1 14 second part regulating water quality and specifically by
  1 15 providing for construction permit and manure management plan
  1 16 requirements (see Code sections 455B.200A and 455B.203).
  1 17    Under current law, many of these provisions do not apply to
  1 18 a small animal feeding operation.  Code section 455B.161
  1 19 defines "small feeding operation" for air quality purposes to
  1 20 mean an operation with an animal weight capacity of 200,000
  1 21 pounds or less for animals other than bovine, or 400,000
  1 22 pounds or less for bovine.  Code section 455B.171 defines the
  1 23 term for water quality purposes as the same as defined in Code
  1 24 section 455B.161.
  1 25    This bill amends the definition of "small animal feeding
  1 26 operation" effective for both parts of the Code chapter to
  1 27 mean an operation having an animal weight capacity of 300,000
  1 28 pounds or less.
