  1  1    Section 1.  Section 455B.133, Code 2001, is amended by
  1  2 adding the following new subsection:
  1  3    NEW SUBSECTION.  10.  Adopt rules allowing a city to
  1  4 conduct a controlled burn of a demolished building subject to
  1  5 the same restrictions as are in effect for fire fighting
  1  6 training fires.  The rules shall include a provision that a
  1  7 city may undertake no more than three controlled burns in
  1  8 every overlapping six-tenths-of-a-mile-radius circle every
  1  9 three years.  The rules shall prohibit a controlled burn of a
  1 10 demolished building in Cedar Rapids, Marion, Hiawatha, Council
  1 11 Bluffs, Carter Lake, Des Moines, West Des Moines, Clive,
  1 12 Windsor Heights, Urbandale, Pleasant Hill, Buffalo, Davenport,
  1 13 Mason City or any other area where area-specific state
  1 14 implementation plans require the control of particulate.
  1 15    Sec. 2.  DEMOLITION SITE WASTE MATERIAL TASK FORCE.
  1 16    1.  The department of natural resources, in cooperation
  1 17 with the department of economic development, shall establish a
  1 18 task force to study issues related to the proper disposal of
  1 19 waste material from buildings demolished in cities and
  1 20 counties.  The task force shall study issues including, but
  1 21 not limited to, all of the following:
  1 22    a.  The proper removal and disposal of waste material
  1 23 containing lead-based paints and asbestos.
  1 24    b.  The proper removal and disposal of any other hazardous
  1 25 waste material or waste material commonly found in old
  1 26 buildings that may be considered a health hazard if removed
  1 27 improperly.
  1 28    c.  Any alternatives to the disposal of waste material from
  1 29 demolition sites such as salvage operations.
  1 30    d.  The training of fire department personnel in relation
  1 31 to the disposal of waste material from demolition sites.
  1 32    e.  Asbestos inspection training for volunteers at the
  1 33 local level.
  1 34    f.  An appropriate local limit for the controlled burning
  1 35 of demolished buildings from which hazardous materials have
  2  1 been removed prior to burning.
  2  2    g.  The proper method for encouraging cooperation between
  2  3 cities and counties on issues related to the disposal of
  2  4 demolition site waste material.
  2  5    2.  The task force membership shall include, but not be
  2  6 limited to, all of the following:
  2  7    a.  Representatives from the department of natural
  2  8 resources knowledgeable in air toxics and toxic materials.
  2  9    b.  Representatives from the department of economic
  2 10 development knowledgeable in community development.
  2 11    c.  A representative of the Iowa league of cities.
  2 12    d.  A representative of the Iowa society of solid waste
  2 13 operators.
  2 14    e.  Four members of the general assembly with not more than
  2 15 one member from each chamber being from the same political
  2 16 party.  The two senators shall be designated by the president
  2 17 of the senate after consultation with the majority and
  2 18 minority leaders of the senate.  The two representatives shall
  2 19 be designated by the speaker of the house of representatives
  2 20 after consultation with the majority and minority leaders of
  2 21 the house of representatives.
  2 22    3.  By January 1, 2003, the task force shall submit a
  2 23 report to the general assembly, including recommendations,
  2 24 regarding issues relating to the disposal of debris from
  2 25 demolition sites in Iowa.
