PAG LIN 1 1 Section 1. NEW SECTION. 455D.22 WHITE GOODS. 1 2 1. As used in this section, unless the context otherwise 1 3 requires: 1 4 a. "White good" means a major household appliance 1 5 including a refrigerator, stove, oven, freezer, dishwasher, 1 6 clothes washer, clothes dryer, and microwave oven. 1 7 b. "Discarded white good" means a white good that will no 1 8 longer be used for its originally intended purpose. 1 9 2. Land disposal of white goods is prohibited. 1 10 3. A retailer that sells a new white good shall charge a 1 11 per unit recycling fee at the time of sale of the white good 1 12 and shall, upon delivery and at no cost to the consumer, offer 1 13 to transfer a discarded white good to an approved collection 1 14 site or a permitted white goods recycler. The per unit 1 15 recycling fee shall be determined by the department and shall 1 16 be based on the cost of handling, transferring, and recycling 1 17 a discarded white good. The per unit recycling fee may 1 18 include an administrative charge. The per unit recycling fee 1 19 may be different for different types of white goods. 1 20 4. A discarded white good shall be taken to an approved 1 21 collection site or a permitted white goods recycler. The 1 22 operator of an approved collection site may temporarily store 1 23 a discarded white good until the discarded white good is 1 24 transferred to a permitted white goods recycler. 1 25 5. The recycling fee charged by the retailer at the point 1 26 of sale shall be remitted to the department. Fifty cents of 1 27 each recycling fee shall be deposited in the white goods 1 28 recycling alternatives account of the groundwater protection 1 29 fund under section 455E.11, subsection 2, paragraph "f". The 1 30 remaining moneys shall be deposited in the white goods account 1 31 of the groundwater protection fund under section 455E.11, 1 32 subsection 2, paragraph "g". 1 33 6. The commission shall adopt rules pursuant to chapter 1 34 17A to administer this section. 1 35 Sec. 2. Section 455E.11, subsection 2, Code 2001, is 2 1 amended by adding the following new paragraphs: 2 2 NEW PARAGRAPH. f. A white goods recycling alternatives 2 3 account. Fifty cents of each recycling fee received from a 2 4 retailer pursuant to section 455D.22 shall be deposited in the 2 5 white goods recycling alternatives account. Moneys in the 2 6 account shall be used by the department to develop and 2 7 implement demonstration projects related to the recycling of 2 8 white goods. 2 9 NEW PARAGRAPH. g. A white goods recycling account. After 2 10 fifty cents is deposited in the white goods recycling 2 11 alternatives account under paragraph "f", all remaining moneys 2 12 from recycling fees received from a retailer pursuant to 2 13 section 455D.22 shall be deposited in the white goods 2 14 recycling account. Moneys in the account shall be distributed 2 15 to a permitted white goods recycler on a per unit basis based 2 16 on the type of white good accepted by the recycler. By the 2 17 seventh day of each month, a permitted white goods recycler 2 18 shall submit a report to the department detailing the number 2 19 and type of white goods accepted by the recycler during the 2 20 previous month. 2 21 EXPLANATION 2 22 This bill relates to the land disposal and recycling of 2 23 white goods. 2 24 The bill prohibits land disposal of white goods. The bill 2 25 provides that "white goods" means a major household appliance 2 26 including a refrigerator, stove, oven, freezer, dishwasher, 2 27 clothes washer, clothes dryer, and microwave oven. 2 28 The bill provides that a retailer selling a new white good 2 29 shall charge a per unit recycling fee, determined by the 2 30 department of natural resources, at the time of sale of the 2 31 white good and shall, upon delivery and at no cost to the 2 32 consumer, offer to transfer a discarded white good to an 2 33 approved collection site or a permitted white goods recycler. 2 34 The bill provides that the recycling fee shall be based on the 2 35 cost of handling, transferring, and recycling a discarded 3 1 white good, and may include an administrative charge. 3 2 The bill provides that a discarded white good shall be 3 3 taken to an approved collection site or a permitted white 3 4 goods recycler. 3 5 The bill provides that the recycling fee shall be remitted 3 6 to the department. The bill provides that 50 cents of the 3 7 recycling fee shall be deposited in the white goods recycling 3 8 alternatives account of the groundwater protection fund. The 3 9 bill provides that moneys in the white goods recycling 3 10 alternatives account shall be used by the department to 3 11 develop and implement demonstration projects related to the 3 12 recycling of white goods. 3 13 The bill provides that the remaining moneys from recycling 3 14 fees shall be deposited in the white goods recycling account. 3 15 The bill provides that moneys in the account shall be 3 16 distributed to a permitted white goods recycler on a per unit 3 17 basis based on the type of white good accepted by the 3 18 recycler. 3 19 LSB 3142HV 79 3 20 tm/gg/8
