1 1 Section 1. Section 257.14, subsection 2, Code 2001, is
1 2 amended by striking the subsection and inserting in lieu
1 3 thereof the following:
1 4 2. For the budget year beginning July 1, 2001, and
1 5 succeeding budget years, a school district which is not
1 6 receiving a budget adjustment pursuant to subsection 1 shall
1 7 be eligible for an adjustment calculating the regular program
1 8 district cost for the budget year utilizing the basic
1 9 enrollment for the budget year. For the budget year beginning
1 10 July 1, 2001, the board of directors of a school district that
1 11 wishes to receive a budget adjustment pursuant to this
1 12 subsection shall, notwithstanding the public notice and
1 13 hearing provisions of chapter 24 or any other provision to the
1 14 contrary, within thirty days following the effective date of
1 15 this Act, adopt a resolution to receive the budget adjustment
1 16 and immediately notify the department of management of the
1 17 adoption of the resolution. For the budget year beginning
1 18 July 1, 2002, and succeeding budget years, the board of
1 19 directors of a school district that wishes to receive a budget
1 20 adjustment pursuant to this subsection shall adopt a
1 21 resolution by April 1 annually and immediately notify the
1 22 department of management of the adoption of the resolution.
1 23 The director of the department of management shall make the
1 24 necessary adjustments to the school district's budget to
1 25 provide the additional allowable growth authorized pursuant to
1 26 this subsection.
1 27 Sec. 2. EFFECTIVE DATE. This Act, being deemed of
1 28 immediate importance, takes effect upon enactment.
1 29 EXPLANATION
1 30 This bill provides that for the budget year beginning July
1 31 1, 2001, and succeeding budget years, a school district which
1 32 is not receiving a budget adjustment pursuant to Code section
1 33 257.14, subsection 1, shall be eligible for a budget
1 34 adjustment calculating the regular program district cost for
1 35 the budget year utilizing the basic enrollment for the budget
2 1 year. The bill provides that for the budget year beginning
2 2 July 1, 2001, the board of directors of a school district that
2 3 wishes to receive this budget adjustment shall,
2 4 notwithstanding the public notice and hearing provisions of
2 5 Code chapter 24 or any other provision to the contrary, within
2 6 30 days following the effective date of the bill, adopt a
2 7 resolution to receive the budget adjustment and immediately
2 8 notify the department of management of the adoption of the
2 9 resolution. The bill provides that for succeeding budget
2 10 years, a school district adopting a resolution to receive the
2 11 adjustment shall adopt a resolution by April 1 annually. The
2 12 bill provides that the director of the department of
2 13 management shall make the necessary adjustments to the school
2 14 district's budget to provide the authorized additional
2 15 allowable growth.
2 16 The bill takes effect upon enactment.
