PAG LIN 1 1 Section 1. Section 8D.2, subsection 5, Code 2001, is 1 2 amended to read as follows: 1 3 5. "Public agency" means a state agency, an institution 1 4 under the control of the board of regents, the judicial branch 1 5 as provided in section 8D.13, subsection 17, a school 1 6 corporation, a city library, a regional library as provided in 1 7 chapter 256, a county library as provided in chapter 336, or a 1 8 judicial district department of correctional services 1 9 established in section 905.2, to the extent provided in 1 10 section 8D.13, subsection 15, an agency of the federal 1 11 government,ora United States post office which receives a 1 12 federal grant for pilot and demonstration projects, or any 1 13 political subdivision of the state not otherwise specified in 1 14 this subsection. 1 15 Sec. 2. Section 8D.11, subsection 4, Code 2001, is amended 1 16 by striking the subsection. 1 17 Sec. 3. Section 8D.13, Code 2001, is amended by adding the 1 18 following new subsection: 1 19 NEW SUBSECTION. 20. Access to the network shall be 1 20 offered to political subdivisions of the state, to the extent 1 21 not otherwise provided for in this chapter, on the same basis 1 22 and at the same rate as applicable to state agencies. 1 23 EXPLANATION 1 24 This bill provides for access to the services of the Iowa 1 25 communications network by political subdivisions of the state. 1 26 Currently, Code section 8D.11, subsection 4, provides that a 1 27 political subdivision of the state receiving communications 1 28 services from the state as of April 1, 1986, may continue to 1 29 do so but communications services shall not be provided or 1 30 resold to additional political subdivisions other than a 1 31 school corporation, a city library, a regional library as 1 32 provided in Code chapter 256, and a county library as provided 1 33 in Code chapter 336. The bill strikes Code section 8D.11, 1 34 subsection 4, and provides that access to the Iowa 1 35 communications network shall be offered to political 2 1 subdivisions of the state not otherwise provided for in Code 2 2 chapter 8D on the same basis and at the same rate as 2 3 applicable to state agencies. 2 4 LSB 2799HH 79 2 5 rn/gg/8
