  1  1    Section 1.  Section 249A.3, subsection 2, Code 2001, is
  1  2 amended by adding the following new paragraph after paragraph
  1  3 a, and renumbering the subsequent paragraph:
  1  4    NEW PARAGRAPH.  aa.  As provided under the federal Breast
  1  5 and Cervical Cancer Prevention and Treatment Act of 2000, Pub.
  1  6 L. No. 106-354, women who meet all of the following criteria:
  1  7    (1)  Are not described in 42 U.S.C. } 1396a(a)(10)(A)(i).
  1  8    (2)  Have not attained age sixty-five.
  1  9    (3)  Have been screened for breast and cervical cancer
  1 10 under the United States centers for disease control and
  1 11 prevention breast and cervical cancer early detection program
  1 12 established under 42 U.S.C. } 300k et seq., in accordance with
  1 13 the requirements of 42 U.S.C. } 300n, and need treatment for
  1 14 breast or cervical cancer.  A woman is considered screened for
  1 15 breast and cervical cancer under this subparagraph if the
  1 16 woman is screened by any provider or entity, and the state
  1 17 grantee of the United States centers for disease control and
  1 18 prevention funds under Title XV of the federal Public Health
  1 19 Services Act has elected to include screening activities by
  1 20 that provider or entity as screening activities pursuant to
  1 21 Title XV of the federal Public Health Services Act.  This
  1 22 screening includes breast or cervical cancer screenings or
  1 23 diagnostic services provided by family planning or community
  1 24 health centers.
  1 25    (4)  Are not otherwise covered under creditable coverage as
  1 26 defined in 42 U.S.C. } 300gg(c).
  1 27    A woman who meets the criteria of this paragraph shall be
  1 28 presumptively eligible for medical assistance.  
  1 29                           EXPLANATION 
  1 30    This bill provides for a new category of optional coverage
  1 31 under the medical assistance program.  The new optional
  1 32 coverage applies to certain women who require treatment for
  1 33 breast or cervical cancer.  Women who meet the criteria
  1 34 specified in the bill are presumptively eligible for medical
  1 35 assistance coverage.
