1 1 Section 1. Section 364.17, Code 2001, is amended by adding
1 2 the following new subsection:
1 3 NEW SUBSECTION. 8. A residence occupied by the owner is
1 4 exempt from this section and shall not be subject to regular
1 5 rental housing inspections or rental housing inspections upon
1 6 receipt of a complaint. A residence occupied by the owner
1 7 includes any residence, regardless of its classification for
1 8 state or federal income tax purposes, in which the owner is
1 9 one of the following:
1 10 a. A legal titleholder pursuant to a recorded deed.
1 11 b. A buyer under a recorded contract for deed.
1 12 c. A beneficiary of a trust where the trust or the trustee
1 13 is the legal titleholder.
1 14 d. A person holding an option to buy under a written
1 15 option agreement if the agreement provides that the person has
1 16 an option to buy the property and the person is responsible
1 17 for maintenance of the property.
1 18 EXPLANATION
1 19 This bill provides that a residence occupied by the owner
1 20 of the residence is not subject to rental housing inspections
1 21 by a city. The bill defines "owner" as a legal titleholder, a
1 22 buyer under a contract for deed, a beneficiary of a trust
1 23 where the trust or its trustee holds legal title to the
1 24 property, or a person who has the option to purchase the
1 25 property under a written option agreement.
