  1  1    Section 1.  Section 453A.13, subsection 3, Code 2001, is
  1  2 amended to read as follows:
  1  3    3.  FEES – EXPIRATION.
  1  4    a.  All permits provided for in this division shall expire
  1  5 on June 30 of each year.  A permit shall not be granted or
  1  6 issued until the applicant has paid for the period ending June
  1  7 30 next, to the department or the city or county granting the
  1  8 permit, the fees provided for in this division.
  1  9    b.  The annual state permit fee for a distributor,
  1 10 cigarette vendor, and wholesaler is one hundred dollars when
  1 11 the permit is granted during the months of July, August, or
  1 12 September.  However, whenever a state permit holder operates
  1 13 more than one place of business, a duplicate state permit
  1 14 shall be issued for each additional place of business on
  1 15 payment of five dollars for each duplicate state permit, but
  1 16 refunds as provided in this division do not apply to any
  1 17 duplicate permit issued.
  1 18    c.  The fee for retail permits is as follows when the
  1 19 permit is granted during the months of July, August, or
  1 20 September:
  1 21    a. (1)  In places outside any city, not less than fifty
  1 22 dollars.
  1 23    b. (2)  In cities of less than fifteen thousand population,
  1 24 not less than seventy-five dollars.
  1 25    c. (3)  In cities of fifteen thousand or more population,
  1 26 not less than one hundred dollars.
  1 27    d.  If any permit is granted during the months of October,
  1 28 November, or December, the fee shall be three-fourths of the
  1 29 above maximum schedule; if granted during the months of
  1 30 January, February, or March, one-half of the maximum schedule,
  1 31 and if granted during the months of April, May, or June, one-
  1 32 fourth of the maximum schedule.
  1 33    e.  Cities and counties may use any portion of the fees
  1 34 collected for retail permits for the enforcement of section
  1 35 142A.6, subsection 6, chapter 142B, section 453A.2, section
  2  1 453A.4, section 453A.36, subsection 6, and section 453A.36A.  
  2  2                           EXPLANATION
  2  3    This bill relates to cigarette retail permit fees.
  2  4    The bill provides a minimum fee to be charged.  Current
  2  5 Code establishes a specific fee.
  2  6    The bill also provides that cities and counties may use any
  2  7 portion of the cigarette retail permit fee collected for
  2  8 enforcement of Code section 142A.6, subsection 6 (cigarette
  2  9 and tobacco product giveaways); Code chapter 142B (smoking
  2 10 prohibitions relating to public places); Code section 453A.2
  2 11 (violations relating to persons under legal age); Code section
  2 12 453A.4 (seizure of false or altered driver's license or
  2 13 nonoperator's identification card); Code section 453A.36,
  2 14 subsection 6 (violations relating to cigarette vending
  2 15 machines); and Code section 453A.36A (violations relating to
  2 16 self-service sales).
