1 1 Section 1. NEW SECTION. 514C.13A GROUP MANAGED CARE
1 2 HEALTH PLANS – PROHIBITION OF INDEMNIFICATION BY HEALTH CARE
1 3 PROVIDERS.
1 4 1. A managed care health plan, as defined in section
1 5 514C.13, shall not contain in a contract with a health care
1 6 provider, as defined in section 514C.13, a provision that
1 7 requires the provider to indemnify or hold harmless the
1 8 managed care health plan.
1 9 2. An indemnification or hold harmless clause entered into
1 10 in violation of subsection 1 is void.
1 11 EXPLANATION
1 12 This bill creates new Code section 514C.13A, to prohibit
1 13 provisions in a contract between a managed care health plan
1 14 and a health care provider that require a health care provider
1 15 to indemnify or hold harmless the managed care health plan.
1 16 The section further provides that such a contract provision is
1 17 void if entered into by a health care provider and a managed
1 18 care health plan.
