  1  4 PROVIDING FOR THE PROTECTION OF PROPRIETARY RIGHTS AND
  1  5    COLLECTION OF FEES FOR SOFTWARE, NETWORK DESIGNS, AND
  1  6    TECHNOLOGY APPLICATIONS OF THE IOWA COMMUNICATIONS NETWORK.

  1  8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  9 
  1 10    Section 1.  NEW SECTION.  8D.11A  PROPRIETARY INTERESTS.
  1 11    The commission may charge a negotiated fee, to recover a
  1 12 share of the costs related to the research and development,
  1 13 initial production, and derivative products of its proprietary
  1 14 software and hardware, telecommunications architecture design,
  1 15 and proprietary technology applications developed to support
  1 16 authorized users, to private vendors and to other political
  1 17 entities and subdivisions, including but not limited to
  1 18 states, territories, protectorates, and foreign countries.
  1 19 The commission may enter into nondisclosure agreements to
  1 20 protect the state of Iowa's proprietary interests.  The
  1 21 provisions of chapter 23A relating to noncompetition by state
  1 22 agencies and political subdivisions with private enterprise
  1 23 shall not apply to commission activities authorized under this
  1 24 section.
  1 25    Sec. 2.  Section 23A.2, subsection 10, Code 2001, is
  1 26 amended by adding the following new paragraph:
  1 27    NEW PARAGRAPH.  n.  The performance of an activity
  1 28 authorized pursuant to section 8D.11A.
