PAG LIN 1 1 Section 1. Section 810.12, subsection 1, Code 2001, is 1 2 amended to read as follows: 1 3 1. The nontestimonial identification order shall be served 1 4 upon the person named or described in the order withinfive1 5 ten days after its issuance, excluding Saturdays, Sundays, and 1 6 legal holidays, between the hours of 8:00 a.m. and 12:00 1 7 midnight, and shall be so served not later than twelve hours 1 8 prior to the time of the person's required participation. 1 9 EXPLANATION 1 10 This bill relates to service of a nontestimonial 1 11 identification order by a law enforcement officer. The bill 1 12 provides that a nontestimonial identification order shall be 1 13 served upon the person named in the order within 10 days of 1 14 the issuance of the order. Current law provides that the 1 15 order must be served upon the person within five days of the 1 16 issuance of the order. 1 17 A nontestimonial identification order requires a person to 1 18 submit evidence in a criminal case including but not limited 1 19 to fingerprints, blood and saliva samples, handwriting 1 20 samples, or hair strands. 1 21 LSB 3018HH 79 1 22 jm/pj/5
