  1  1    Section 1.  Section 80.17, Code 2001, is amended to read as
  1  2 follows:
  1  3    80.17  GENERAL ALLOCATION OF DUTIES.
  1  4    In general, the The allocation of duties of the department
  1  5 of public safety shall be as follows:
  1  6    1.  Commissioner's office.
  1  7    2.  Division of statistics and records.
  1  8    3.  Division of criminal investigation and bureau of
  1  9 identification.
  1 10    4.  Division of the Iowa state patrol.
  1 11    5.  Division of fire protection.
  1 12    6.  Division of inspection.
  1 13    7.  Division of capitol police.
  1 14    Nothing in the aforesaid allocation of duties shall be
  1 15 interpreted to prevent flexibility in interdepartmental
  1 16 operations or to forbid other divisional allocations of duties
  1 17 in the discretion of the commissioner of public safety.  The
  1 18 commissioner shall have discretion to exercise flexibility in
  1 19 interdepartmental operations and may allocate duties between
  1 20 divisions but shall not transfer, reassign, or reallocate
  1 21 personnel between divisions unless expressly authorized in
  1 22 law.  
  1 23                           EXPLANATION
  1 24    This bill relates to the duties of the commissioner of
  1 25 public safety and of the department of public safety.  The
  1 26 bill provides that the commissioner may exercise flexibility
  1 27 in interdepartmental operations and may allocate duties
  1 28 between divisions but shall not transfer, reassign, or
  1 29 reallocate personnel between divisions unless expressly
  1 30 authorized in law.
