  1  1    Section 1.  Section 321.194, subsection 2, Code 2001, is
  1  2 amended to read as follows:
  1  3    2.  SUSPENSION AND REVOCATION.  A driver's license issued
  1  4 under this section is subject to suspension or revocation for
  1  5 the same reasons and in the same manner as suspension or
  1  6 revocation of any other driver's license.  The department may
  1  7 also suspend a driver's license issued under this section upon
  1  8 receiving satisfactory evidence that the licensee has violated
  1  9 the restrictions of the license or has been involved in one or
  1 10 more accidents chargeable to the licensee.  The department may
  1 11 suspend a driver's license issued under this section upon
  1 12 receiving a record of the licensee's conviction for one
  1 13 violation.  The department shall revoke the license upon
  1 14 receiving a record of conviction for two or more violations of
  1 15 a law of this state or a city ordinance regulating the
  1 16 operation of motor vehicles on highways other than parking
  1 17 violations as defined in section 321.210.  After a person
  1 18 licensed under this section receives two or more convictions
  1 19 which require revocation of the person's license under this
  1 20 section, the department shall not grant an application for a
  1 21 new driver's license until the expiration of one year.
  1 22 However, a person who has received two or more convictions
  1 23 that require revocation of the person's license under this
  1 24 section may apply for and receive an instruction permit under
  1 25 section 321.180B.  
  1 26                           EXPLANATION
  1 27    This bill modifies a provision in Code section 321.194 that
  1 28 currently prohibits a person who has had the person's school
  1 29 driver's license revoked for violations relating to the
  1 30 operation of a motor vehicle from receiving a new driver's
  1 31 license for one year.  The bill provides that the prohibition
  1 32 on receiving a new driver's license for one year does not
  1 33 apply to instruction permits issued under Code section
  1 34 321.180B.
