PAG LIN 1 1 Section 1. LEGISLATIVE FINDINGS. 1 2 1. The general assembly finds that since there has not 1 3 been an open season for mourning doves in Iowa since 1918, and 1 4 many Iowans consider the mourning dove as a symbol of peace 1 5 commemorating the service and sacrifice of World War I 1 6 veterans, the mourning dove should be given a permanent status 1 7 as a protected game bird in this state. 1 8 2. The general assembly also finds that there are many 1 9 other species of game birds for which open hunting seasons 1 10 have been established for hunters. 1 11 Sec. 2. NEW SECTION. 481A.49 MOURNING DOVE PROTECTED 1 12 GAME BIRD. 1 13 1. The mourning dove is a protected migratory game bird. 1 14 The closed season for mourning doves is perpetual. 1 15 2. A person who willfully attempts to take or takes a 1 16 mourning dove commits a scheduled violation under section 1 17 805.8, subsection 5, paragraph "h". 1 18 Sec. 3. Section 805.8, subsection 5, paragraph h, 1 19 unnumbered paragraph 1, Code 2001, is amended to read as 1 20 follows: 1 21 For violations of section 481A.48 or 481A.49 relating to 1 22 restrictions on game birds and animals, the scheduled fines 1 23 are as follows: 1 24 EXPLANATION 1 25 This bill provides that a mourning dove is a protected 1 26 migratory game bird and that the hunting season for mourning 1 27 doves is perpetually closed. A person who willfully attempts 1 28 to take or takes a mourning dove commits a scheduled 1 29 violation. The scheduled fine for taking a mourning dove out 1 30 of season is $100 and for attempting to take a mourning dove 1 31 is $50. In addition, a civil penalty of $50 for each bird 1 32 taken may be assessed. 1 33 LSB 2555HH 79 1 34 tj/cls/14
