PAG LIN 1 1 Section 1. Section 256B.15, subsection 7, paragraph b, 1 2 Code 2001, is amended to read as follows: 1 3 b. The area education agencies shall, after determining 1 4 the administrative costs associated with the implementation of 1 5 medical assistance reimbursement for the eligible services, be 1 6 permitted to retain up to twenty-five percent of the federal 1 7 portion of the total amount reimbursed to pay for the 1 8 administrative costs. This limitation does not apply to 1 9 medical assistance reimbursement for services provided by an 1 10 area education agency under part C of the federal Individuals 1 11 With Disabilities Education Act. Funds received under this 1 12 section shall not be considered or included as part of the 1 13 area education agencies' budgets when calculating funds that 1 14 are to be received by area education agencies during a fiscal 1 15 year. 1 16 EXPLANATION 1 17 This bill provides that a cap of 25 percent applied to the 1 18 amount of federal medical assistance reimbursement that an 1 19 area education agency (AEA) may retain for the administrative 1 20 costs of implementing reimbursement for eligible services, 1 21 does not apply to medical assistance reimbursement for 1 22 services the AEA provides under the Infants and Toddlers with 1 23 Disabilities Program (part C) of the federal Individuals With 1 24 Disabilities Education Act. 1 25 LSB 2425YH 79 1 26 kh/cf/24
