  1 15    Sec. 5.  Section 483A.1, subsection 3, paragraph a, Code
  1 16 2001, is amended to read as follows:  
  1 17    a.  Fishing, seven-day license, catch and release 
  1 18 ........................................................ $ 8.50
  1 19    Sec. 6.  Section 483A.1, subsection 3, Code 2001, is
  1 20 amended by adding the following new paragraph:  
  1 21    NEW PARAGRAPH.  aa.  Fishing, seven-day, fish keeping
  1 22 ....................................................... $ 16.50
  1 23    Sec. 7.  NEW SECTION.  483A.6A  FISH KEEPING LICENSE FEE.
  1 24    1.  Except as provided in subsection 2, a person who is
  1 25 licensed or authorized to fish in this states shall not keep
  1 26 or possess a fish unless that person has paid a fish keeping
  1 27 license fee as provided in section 483A.1.  A resident or
  1 28 nonresident minor who is not required to have a fishing
  1 29 license shall also pay the fish keeping license fee unless the
  1 30 minor is fishing with a licensed adult who has paid the fish
  1 31 keeping license fee and their combined catch is limited to the
  1 32 daily limit established by the commission.  The proceeds from
  1 33 the fee shall be credited to the state fish and game
  1 34 protection fund.
  1 35    2.  Subsection 1 does not apply to persons who release the
  2  1 fish after each catch, to persons who are fishing for trout in
  2  2 compliance with sections 483A.6 and 483A.24, subsection 5, or
  2  3 to persons who are authorized fishing privileges pursuant to
  2  4 section 483A.24, subsection 6, 9, 12, 13, or 14, or section
  2  5 483A.38.
  2  6    Sec. 8.  EFFECTIVE AND APPLICABILITY DATES.  This Act takes
  2  7 effect December 15, 2001, and applies to fish keeping fees for
  2  8 the years beginning on or after January 1, 2002.  
  2  9                           EXPLANATION
  2 10    This bill establishes a fish keeping license fee which must
  2 11 be paid if a person wishes to keep the fish caught.  The fee
  2 12 is $15.50 for a resident season license holder, $33.50 for a
  2 13 nonresident license holder, and $16.50 for a resident or
  2 14 nonresident seven-day license holder.  The fish keeping
  2 15 license fee is also required of resident and nonresident
  2 16 minors who are not required to have a fishing license unless
  2 17 the minors are fishing with a licensed adult who has paid the
  2 18 fish keeping license fee and their combined catch is within
  2 19 the established daily catch limit.  The proceeds of the fish
  2 20 keeping license fee shall be credited to the state fish and
  2 21 game protection fund.
  2 22    The fish keeping license fee does not apply to persons who
  2 23 catch and release the fish, to persons who are fishing for
  2 24 trout, to persons who receive special fishing licenses because
  2 25 of severe mental or physical disabilities, to patients of
  2 26 substance abuse facilities, residents of health care
  2 27 facilities, to persons cared for in juvenile shelter care
  2 28 homes, to disabled veterans and veterans who were prisoners of
  2 29 war and who have purchased lifetime combined hunting and
  2 30 fishing licenses, to persons with permanent disabilities whose
  2 31 income falls below the federal poverty guidelines, or persons
  2 32 65 years of age or older whose income falls below the federal
  2 33 poverty guidelines, or to persons who are participating in the
  2 34 annual free fishing days established by the natural resource
  2 35 commission.
  3  1    The penalty for a violation is a scheduled fine of $100
  3  2 under Code section 483A.42.
  3  3    This Act takes effect December 15, 2001, and applies to
  3  4 fish keeping license fees for the years beginning on or after
  3  5 January 1, 2002.
