  1  1    Section 1.  Section 249A.3, Code 2001, is amended by adding
  1  2 the following new subsection:
  1  3    NEW SUBSECTION.  14.  If allowed under federal law, in
  1  4 calculating the amount of countable income under the medically
  1  5 needy program for an individual who is a recipient of federal
  1  6 supplemental security income, the amount which is the
  1  7 difference between the income limit for federal supplemental
  1  8 security income and the income limit for the medically needy
  1  9 program shall be disregarded.  
  1 10                           EXPLANATION
  1 11    This bill provides that in calculating the amount of an
  1 12 individual's countable income under the medically needy
  1 13 program, if the individual is a recipient of federal
  1 14 supplemental security income, the amount which is the
  1 15 difference between the income limit for federal supplemental
  1 16 security income and the income limit for the medically needy
  1 17 program is to be disregarded.  The result of this is that the
  1 18 individual will be eligible for the medically needy program
  1 19 without meeting a spenddown requirement.  The spenddown
  1 20 requirement is the process by which an individual's countable
  1 21 income in excess of the medically needy income level for that
  1 22 individual must be reduced, through obligation for allowable
  1 23 medical expenses, in order to reach the medically needy income
  1 24 level for the individual.
