1 4 ESTABLISHING A RURAL FIRE PROTECTION PROGRAM AND LIMITING THE
1 5 LIABILITY OF RURAL WATER DISTRICTS AND ASSOCIATIONS IN
1 6 CONNECTION WITH THE PROVISION OF WATER FOR FIRE PROTECTION.

1 8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 10 Section 1. NEW SECTION. 357A.22A RURAL FIRE PROTECTION
1 11 PROGRAM – LIABILITY.
1 12 A rural water district or rural water association
1 13 incorporated under this chapter or chapter 504A shall
1 14 establish a rural fire protection program which shall include,
1 15 but is not limited to, providing access to designated soft-
1 16 hose fill stations, providing annually or more often if
1 17 necessary updated maps of soft-hose fill stations to all fire
1 18 departments within the rural water service area, and
1 19 sponsoring informational meetings for all fire departments and
1 20 interested parties within the rural water service area for the
1 21 purpose of reviewing locations of facilities, operational
1 22 procedures, communication procedures and facilities, and
1 23 procedures designed to coordinate efforts to enhance rural
1 24 fire protection.
1 25 A rural water district or rural water association
1 26 incorporated under this chapter or chapter 504A which provides
1 27 water service to cities, benefited fire districts, or
1 28 townships shall not be liable for a claim against the district
1 29 or association for failure to provide or maintain fire
1 30 hydrants, facilities or an adequate supply of water or water
1 31 pressure for fire protection purposes if the purpose of the
1 32 hydrants, facilities, or water used is not for fire
1 33 protection. Not later than July 1, 2006, the legislative
1 34 council shall provide for a review of the liability exemption
1 35 or limitation provided for rural water districts or rural
2 1 water associations under this paragraph and assess its effect
2 2 on the provision of fire protection in areas served by the
2 3 rural water districts or rural water associations.
