PAG LIN 1 1 Section 1. Section 19A.9, subsection 12, Code 2001, is 1 2 amended to read as follows: 1 3 12. For reinstatement of persons who have attained 1 4 permanent status, including employees of the state board of 1 5 regents, and who resign in good standing or who are laid off 1 6 from their positions without fault or delinquency on their 1 7 part, and including but not limited to restoration of those 1 8 persons' sick leave accrued during any previous period of 1 9 permanent employment with the state. 1 10 Sec. 2. Section 70A.1, unnumbered paragraph 6, Code 2001, 1 11 is amended to read as follows: 1 12 Separation from state employment shall cancel all unused 1 13 accrued sick leave. However, if an employee is laid off or 1 14 resigns in good standing and the employee isre-employed1 15 reemployed by any state department, board, agency, or 1 16 commission, including the state board of regentswithin one1 17year of the date of the layoff, accrued sick leave of the 1 18 employee shall be restored. 1 19 Sec. 3. EFFECTIVE DATE RETROACTIVE APPLICABILITY. This 1 20 Act, being deemed of immediate importance, takes effect upon 1 21 enactment and is retroactively applicable to any employee 1 22 reinstated prior to this Act's effective date, except that 1 23 recalculation of restored seniority and benefits of a 1 24 reinstated state employee is retroactively applicable to 1 25 January 1, 2000. 1 26 EXPLANATION 1 27 This bill provides that a former state employee who returns 1 28 to state employment prior to the effective date of this bill 1 29 will be considered reinstated as a state employee, including 1 30 but not limited to restoration of any sick leave accrued by 1 31 that person during that person's previous period of permanent 1 32 state employment. The bill takes effect upon enactment and is 1 33 retroactive to apply to any state employee who returns to 1 34 state employment before the effective date of the bill. 1 35 Recalculation of such an employee's seniority and benefits is 2 1 retroactive to January 1, 2000, the date on which 2000 Iowa 2 2 Acts, chapter 1171, section 12, was retroactively applicable. 2 3 LSB 2359YH 79 2 4 av/cls/14
