  1  1    Section 1.  Section 321.290, unnumbered paragraph 2, Code
  1  2 2001, is amended to read as follows:
  1  3    Whenever Subject to the restrictions of section 321.293,
  1  4 whenever the council in any city shall determine determines
  1  5 upon the basis of an engineering and traffic investigation
  1  6 that any speed limit hereinbefore set forth stated in section
  1  7 321.285 is greater or less than is reasonable or safe under
  1  8 the conditions found to exist at any intersection or other
  1  9 place or upon any part of the city street system, except
  1 10 primary road extensions, said the council shall determine and
  1 11 adopt by ordinance such a higher or lower speed limit as it
  1 12 deems reasonable and safe thereat at the place or part of the
  1 13 street.  Such The speed limit shall be effective when proper
  1 14 and appropriate signs giving notice thereof of the speed limit
  1 15 are erected at such intersections or other place or part of
  1 16 the street.  
  1 17                           EXPLANATION
  1 18    This bill allows a city council to adopt an ordinance
  1 19 setting a higher or lower speed limit on any part of a primary
  1 20 road extension that is part of the city street system if the
  1 21 city council determines, based on an engineering and traffic
  1 22 investigation, that a speed limit provided for in the Code is
  1 23 greater or less than is reasonable or safe under the existing
  1 24 conditions on that part of the primary road extension.  The
  1 25 bill provides that this authority is limited by Code section
  1 26 321.293, which places restrictions on the adoption of higher
  1 27 speed limits on certain through highways within a local
  1 28 authority's jurisdiction.  The different speed limit must also
  1 29 be based on an engineering and traffic investigation.
  1 30 Currently, a city council is allowed to adopt an ordinance
  1 31 setting a different speed limit on a city street that is not a
  1 32 primary road extension.
