  1  1    Section 1.  Section 257.31, subsection 5, paragraph j, Code
  1  2 2001, is amended to read as follows:
  1  3    j.  Unusual need to continue providing a program or other
  1  4 special assistance to non-English speaking pupils after the
  1  5 expiration of the three-year four-year period specified in
  1  6 section 280.4.
  1  7    Sec. 2.  Section 280.4, subsection 3, Code 2001, is amended
  1  8 to read as follows:
  1  9    3.  In order to provide funds for the excess costs of
  1 10 instruction of limited English proficient students above the
  1 11 costs of instruction of pupils in a regular curriculum,
  1 12 students identified as limited English proficient shall be
  1 13 assigned an additional weighting that shall be included in the
  1 14 weighted enrollment of the school district of residence for a
  1 15 period not exceeding three four years.  However, the school
  1 16 budget review committee may grant supplemental aid or modified
  1 17 allowable growth to a school district to continue funding a
  1 18 program for students after the expiration of the three-year
  1 19 four-year period.  The school budget review committee shall
  1 20 calculate the additional amount for the weighting to the
  1 21 nearest one-hundredth of one percent so that to the extent
  1 22 possible the moneys generated by the weighting will be
  1 23 equivalent to the moneys generated by the two-tenths weighting
  1 24 provided prior to July 2, 1991.  
  1 25                           EXPLANATION 
  1 26    This bill extends the period of time during which the
  1 27 additional weighting for limited English proficient pupils may
  1 28 be obtained from three to four years.
  1 29    The bill provides for a corresponding change to Code
  1 30 section 257.31, subsection 5, paragraph "j", concerning
  1 31 requests by school districts for supplemental aid from the
  1 32 school budget review committee based upon an unusual need to
  1 33 continue a program relating to limited English proficiency
  1 34 beyond a four-year period.
