1 1 Section 1. Section 805.8, Code 2001, is amended by adding
1 2 the following new subsection:
1 3 NEW SUBSECTION. 2B. MOVING TRAFFIC VIOLATIONS – USE OF
1 4 CELLULAR TELEPHONE. The scheduled fine for a moving traffic
1 5 violation under chapter 321 as provided in this section shall
1 6 be doubled if the violation occurs while the operator of the
1 7 vehicle is using a cellular telephone. This subsection shall
1 8 not apply if the operator was using the cellular telephone to
1 9 call a 911 or other emergency telephone number. For purposes
1 10 of this subsection, "cellular telephone" means a hand-held
1 11 radio-link telephone that provides dial tone access to a
1 12 portable, mobile, or fixed location for which a charge is
1 13 levied.
1 14 EXPLANATION
1 15 This bill doubles the scheduled fines for moving traffic
1 16 violations if the violation occurred while the operator of the
1 17 vehicle was using a cellular telephone. The increased fine
1 18 does not apply if the operator was using the cellular
1 19 telephone to call a 911 or other emergency telephone number.
