1 1 Section 1. MEDICAL ASSISTANCE – PERSONAL NEEDS ALLOWANCE.
1 2 The department of human services shall adopt rules which
1 3 provide that the personal needs allowance under the medical
1 4 assistance program, which is retained by a resident of a
1 5 health care facility, is fifty dollars per month, unless a
1 6 greater amount is allowed under state or federal law.
1 7 Sec. 2. There is appropriated from the general fund of the
1 8 state to the department of human services for the fiscal year
1 9 beginning July 1, 2001, and ending June 30, 2002, the
1 10 following amount, or so much thereof as is necessary, to be
1 11 used for the purpose designated:
1 12 For provision of a personal needs allowance of $50 per
1 13 month to be retained by a resident of a health care facility
1 14 under the medical assistance program:

1 16 EXPLANATION
1 17 This bill directs the department of human services to adopt
1 18 rules to allow residents of health care facilities
1 19 participating in the medical assistance program to retain a
1 20 personal needs allowance of $50 per month, unless a greater
1 21 amount is allowed to be retained under state or federal law.
1 22 The current personal needs allowance is $30 per month. The
1 23 bill also appropriates $1.5 million from the general fund of
1 24 the state to the department of human services for the fiscal
1 25 year beginning July 1, 2001, and ending June 30, 2002, to
1 26 cover the cost of the increased allowance.
