  1  1           HOUSE CONCURRENT RESOLUTION NO. ___

  1  3 A Concurrent Resolution requesting the establishment
  1  4    of a legislative interim study committee to review
  1  5    penalties and sentencing practices for criminal
  1  6    offenses related to cocaine, derivatives of cocaine,
  1  7    and substances containing a cocaine base such as
  1  8    crack cocaine.
  1  9    WHEREAS, the possession, manufacturing, and
  1 10 distribution of cocaine, derivatives of cocaine, and
  1 11 substances containing a cocaine base are a significant
  1 12 problem in Iowa; and
  1 13    WHEREAS, there currently exists disparities in
  1 14 criminal penalties in the Iowa Code for possession,
  1 15 manufacturing, and distribution of cocaine,
  1 16 derivatives of cocaine, and substances containing a
  1 17 cocaine base; and
  1 18    WHEREAS, the disparities in criminal penalties may
  1 19 lead to disparities in the prosecution and sentencing
  1 20 of offenders who have essentially committed the same
  1 21 crime; and
  1 22    WHEREAS, the criminal penalties and sentencing
  1 23 practices for possession, manufacturing, and
  1 24 distribution of cocaine, derivatives of cocaine, and
  1 25 substances containing a cocaine base, are in need of
  1 26 review; NOW THEREFORE,
  1 27    BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES, THE
  1 28 SENATE CONCURRING, That the legislative council is
  1 29 requested to establish a legislative study committee
  1 30 during the 2001 interim to review disparities in
  2  1 criminal penalties and sentencing practices for
  2  2 possession, manufacturing, and distribution of
  2  3 cocaine, derivatives of cocaine, and substances
  2  4 containing a cocaine base.  In addition to legislators
  2  5 and a member from a racial minority group, membership
  2  6 on the committee should include but is not limited to
  2  7 representatives of the following:  county attorneys,
  2  8 judicial branch, local law enforcement, department of
  2  9 corrections, board of parole, a community organization
  2 10 committed to serve exoffenders, and a person who has
  2 11 been convicted of a criminal offense involving
  2 12 possession, manufacturing, or distribution of cocaine,
  2 13 a derivative of cocaine, or a substance containing a
  2 14 cocaine base.
