1 3 #1. By striking page 57, line 21 through page 64,
1 4 line 3 and inserting the following:
1 5 "Sec. . COUNTY INTERIM SITING OF CONFINEMENT
1 6 FEEDING OPERATION STRUCTURES.
1 7 1. A county board of supervisors may adopt a
1 8 confinement feeding operations siting ordinance,
1 9 pursuant to section 331.302. The purpose of the
1 10 ordinance shall be to allow approval of the siting of
1 11 a confinement feeding operation structure regardless
1 12 of whether the board has adopted an ordinance under
1 13 chapter 335.
1 14 a. The ordinance shall apply to the siting of
1 15 confinement feeding operation structures which must
1 16 obtain a construction permit pursuant to section
1 17 455B.200A.
1 18 b. The ordinance shall authorize a county to
1 19 approve the site of the construction or expansion of a
1 20 confinement feeding operation structure in order to
1 21 preserve and protect natural resources, including
1 22 water sources and fragile environmental locations;
1 23 lessen congestion and overcrowding of confinement
1 24 feeding operations, especially near cities; and
1 25 protect the health and welfare of the public.
1 26 2. The county's decision shall be based on all of
1 27 the following:
1 28 a. The proximity to the proposed construction site
1 29 of any of the following:
1 30 (1) Human population areas and tourism
1 31 attractions.
1 32 (2) Fragile land areas including but not limited
1 33 to designated wetlands, floodplains, or areas with
1 34 rare or valuable ecosystems.
1 35 (3) Water sources including major water sources
1 36 used as drinking water supplies; watersheds; high-
1 37 quality water resources; and aquifers and their
1 38 recharge areas.
1 39 (4) Public use areas or critical public areas.
1 40 b. The availability of land required for the
1 41 application of manure originating from the confinement
1 42 feeding operation as provided in section 455B.203.
1 43 c. The geology and hydrology of the site.
1 44 d. The impact of the confinement feeding
1 45 operation, after construction of the proposed
1 46 confinement feeding operation structure, on the
1 47 services of any city located in proximity to the
1 48 confinement feeding operation or the county in which
1 49 the confinement feeding operation is located.
1 50 e. The extent to which the applicant has complied
2 1 with requirements under this division for other animal
2 2 feeding operations owned by the applicant.
2 3 3. An ordinance adopted under this section shall
2 4 provide for methods and procedures required for
2 5 submission of proposals, review of proposals, and
2 6 approval of a site for the construction or expansion
2 7 of a proposed confinement feeding operation structure.
2 8 In administering the ordinance, the board may
2 9 establish a confinement feeding operations siting
2 10 commission which shall review each proposal for the
2 11 construction or expansion of a confinement feeding
2 12 operation, and recommend to the county board of
2 13 supervisors that the board approve or disapprove the
2 14 proposal. The commission shall make its
2 15 recommendation to the board and the board shall
2 16 approve or disapprove a proposal within thirty days
2 17 after the date that the county receives the proposal.
2 18 The board shall notify the department of its decision
2 19 to approve or disapprove the proposal in the same
2 20 manner as required to provide comments prior to March
2 21 1, 2003, as provided in this Act."
2 22 #2. Page 64, by striking lines 7 through 10 and
2 23 inserting the following:
2 24 "Sec. . INTERIM PROCESS REPEALED. The section
2 25 of this Act providing for the interim siting of
2 26 confinement feeding operation structures by county
2 27 boards of supervisors is repealed March 1, 2003."
2 28 #3. By renumbering as necessary.
