Page 136, by inserting after line 6, the 1 14 following: 1 15 "Sec. . NEW SECTION. 249A.21 INTERMEDIATE 1 16 CARE FACILITIES FOR PERSONS WITH MENTAL RETARDATION 1 17 ASSESSMENT. 1 18 1. The department may assess intermediate care 1 19 facilities for persons with mental retardation, as 1 20 defined in section 135C.1, that are not operated by 1 21 the state, a fee in an amount not to exceed six 1 22 percent of the total annual revenue of the facility 1 23 for the preceding fiscal year. Counties shall not be 1 24 required to participate in the cost of the assessment. 1 25 2. The assessment shall be paid to the department 1 26 in equal monthly amounts on or before the fifteenth 1 27 day of each month. The department may deduct the 1 28 monthly amount from medical assistance payments to a 1 29 facility described in subsection 1. The amount 1 30 deducted from payments shall not exceed the total 1 31 amount of the assessments due. 1 32 3. Revenue from the assessments shall be credited 1 33 to the state medical assistance appropriation. This 1 34 revenue may be used only for services for which 1 35 federal financial participation under the medical 1 36 assistance program is available to match state funds. 1 37 4. If federal financial participation to match the 1 38 assessments made under subsection 1 becomes 1 39 unavailable under federal law, the department shall 1 40 terminate the imposing of the assessments beginning on 1 41 the date that the federal statutory, regulatory, or 1 42 interpretive change takes effect. 1 43 5. The department of human services may procure a 1 44 sole source contract to implement the provisions of 1 45 this section." 1 46 #6. Page 142, by inserting after line 20, the 1 47 following: 1 48 " .
