1 18 CARE FACILITIES FOR PERSONS WITH MENTAL RETARDATION
1 19 ASSESSMENT.
1 20 1. The department may assess intermediate care
1 21 facilities for persons with mental retardation, as
1 22 defined in section 135C.1, that are not operated by
1 23 the state, a fee in an amount not to exceed six
1 24 percent of the total annual revenue of the facility
1 25 for the preceding fiscal year. Counties shall not be
1 26 required to participate in the cost of the assessment.
1 27 2. The assessment shall be paid to the department
1 28 in equal monthly amounts on or before the fifteenth
1 29 day of each month. The department may deduct the
1 30 monthly amount from medical assistance payments to a
1 31 facility described in subsection 1. The amount
1 32 deducted from payments shall not exceed the total
1 33 amount of the assessments due.
1 34 3. Revenue from the assessments shall be credited
1 35 to the state medical assistance appropriation. This
1 36 revenue may be used only for services for which
1 37 federal financial participation under the medical
1 38 assistance program is available to match state funds.
1 39 4. If federal financial participation to match the
1 40 assessments made under subsection 1 becomes
1 41 unavailable under federal law, the department shall
1 42 terminate the imposing of the assessments beginning on
1 43 the date that the federal statutory, regulatory, or
1 44 interpretive change takes effect.
1 45 5. The department of human services may procure a
1 46 sole source contract to implement the provisions of
1 47 this section."
1 48 #7. Page 142, by inserting after line 20, the
1 49 following:

2 1 relating to the assessment on intermediate care
2 2 facilities for persons with mental retardation."
