1 40 FACILITY CROSSOVER PAYMENTS.
1 41 Beginning July 1, 2002, reimbursement under the
1 42 medical assistance program for nursing facility
1 43 crossover payments shall be the lesser of the
1 44 following:
1 45 1. The cost amount allowed under the medical
1 46 assistance program minus the federal Medicare payment.
1 47 2. The federal Medicare coinsurance and deductible
1 48 amounts.
1 49 Sec. . NEW SECTION. 249A.21 INTERMEDIATE CARE
1 50 FACILITIES FOR PERSONS WITH MENTAL RETARDATION
2 1 ASSESSMENT.
2 2 1. The department may assess intermediate care
2 3 facilities for persons with mental retardation, as
2 4 defined in section 135C.1, that are not operated by
2 5 the state, a fee in an amount not to exceed six
2 6 percent of the total annual revenue of the facility
2 7 for the preceding fiscal year.
2 8 2. The assessment shall be paid to the department
2 9 in equal monthly amounts on or before the fifteenth
2 10 day of each month. The department may deduct the
2 11 monthly amount from medical assistance payments to a
2 12 facility described in subsection 1. The amount
2 13 deducted from payments shall not exceed the total
2 14 amount of the assessments due.
2 15 3. Revenue from the assessments shall be credited
2 16 to the state medical assistance appropriation. This
2 17 revenue may be used only for services for which
2 18 federal financial participation under the medical
2 19 assistance program is available to match state funds.
2 20 4. If federal financial participation to match the
2 21 assessments made under subsection 1 becomes
2 22 unavailable under federal law, the department shall
2 23 terminate the imposing of the assessments beginning on
2 24 the date that the federal statutory, regulatory, or
2 25 interpretive change takes effect.
2 26 5. The department of human services may procure a
2 27 sole source contract to implement the provisions of
2 28 this section."
