1 2 as passed by the Senate, as follows:
1 3 #1. Page 1, by inserting before line 3, the
1 4 following:
1 5 "# . Page 1, by inserting before line 1, the
1 6 following:
1 7 "Section 1. NEW SECTION. 73A.22 SPECIFIC
1 8 PRODUCTS IN PLANS OR SPECIFICATIONS PROHIBITED.
1 9 1. Plans or specifications for a public
1 10 improvement shall not specify, endorse, or recommend
1 11 the use of a specific product or brand of product
1 12 unless the plans or specifications state the test or
1 13 standard by which the product is demonstrated to be
1 14 superior or unless equivalent products or brands are
1 15 also listed in the plans or specifications, or unless
1 16 a separate performance specification is prepared.
1 17 2. For purposes of this section, "public
1 18 improvement" means a public improvement as defined in
1 19 section 73A.1 and includes road construction,
1 20 reconstruction, and maintenance projects.
1 21 3. This section applies to the state, its
1 22 agencies, and any political subdivisions of the state.
1 23 4. If it is determined that application of this
1 24 section may cause denial of federal funds that would
1 25 otherwise be available, or would otherwise be
1 26 inconsistent with requirements of federal law, this
1 27 section shall be suspended, but only to the extent
1 28 necessary to prevent denial of the funds or to
1 29 eliminate the inconsistency with federal
1 30 requirements.""
1 31 #2. Page 12, by inserting before line 50, the
1 32 following:
1 33 "# . Title page, line 1, by inserting after the
1 34 word "to" the following: "public improvements,
1 35 including plans or specifications for public
1 36 improvements,"."
1 37 #3. Page 13, line 1, by inserting after the word
1 38 "and" the following: "utilization".
