  1  1    Amend the amendment, H-8422, to Senate File 2228,
  1  2 as passed by the Senate, as follows:
  1  3    #1.  Page 1, by inserting after line 2, the
  1  4 following:
  1  5    "#   .  Page 1, by inserting before line 1, the
  1  6 following:
  1  7    "Section 1.  Section 12.82, subsection 1, Code
  1  8 Supplement 2001, is amended to read as follows:
  1  9    1.  A school infrastructure fund is created and
  1 10 established as a separate and distinct fund in the
  1 11 state treasury under the control of the department of
  1 12 education.  The fund shall be used for purposes of the
  1 13 school infrastructure program established in section
  1 14 292.2 or for the purposes specified in subsection 5,
  1 15 as applicable.
  1 16    Sec.    .  Section 12.82, Code Supplement 2001, is
  1 17 amended by adding the following new subsection:
  1 18    NEW SUBSECTION.  5.  Beginning January 1, 2003,
  1 19 chapter 292 shall not apply to the distribution and
  1 20 use of the moneys in the school infrastructure fund.
  1 21 Moneys in the school infrastructure fund shall be
  1 22 distributed to all school districts on a per pupil
  1 23 basis.  In computing the per pupil amount for each
  1 24 school district, the department of education shall use
  1 25 the same actual enrollment figures that are used for
  1 26 purposes of computing the combined actual enrollment
  1 27 for school districts in a county as provided in
  1 28 section 298B.1, subsection 1, paragraph "b",
  1 29 subparagraph (2).
  1 30    The moneys received by a school district from the
  1 31 school infrastructure fund shall only be used for
  1 32 school infrastructure purposes.  For the purposes of
  1 33 this subsection, "school infrastructure" means
  1 34 activities authorized in section 296.1 but does not
  1 35 include those activities related to stadiums, bus
  1 36 barns, a home or homes of a teacher or superintendent,
  1 37 procuring and improving a site for an athletic field,
  1 38 or improving a site already owned for an athletic
  1 39 field.""
  1 40    #2.  Page 1, line 14, by inserting after the word
  1 41 "fund" the following:  "shall be transferred as
  1 42 provided in subsection 3A and after such transfer the
  1 43 remaining moneys".
  1 44    #3.  Page 3, by inserting after line 48 the
  1 45 following:
  1 46    "3A.  There shall be transferred from the moneys
  1 47 credited in a fiscal year to the school district sales
  1 48 tax fund to the general fund of the state the sum of
  1 49 twenty million dollars for the fiscal year beginning
  1 50 July 1, 2002.  The twenty million dollars so
  2  1 transferred is appropriated to the department of
  2  2 education for continued support of the student
  2  3 achievement and teacher quality program in accordance
  2  4 with section 284.13."
