  1  1    Amend the amendment, H-8309, to Senate File 503, as
  1  2 amended, passed, and reprinted by the Senate, as
  1  3 follows:
  1  4    #1.  Page 1, by striking lines 7 and 8, and
  1  5 inserting the following:
  1  6    "b.  A runoff control basin which that collects and
  1  7 stores only".
  1  8    #2.  Page 1, by striking lines 17 through 22, and
  1  9 inserting the following:
  1 10    "NEW SUBSECTION.  18A.  "Open feedlot" means an
  1 11 unroofed or partially roofed animal feeding operation
  1 12 in which no crop, vegetation, or forage growth or
  1 13 residue cover is maintained during the period that
  1 14 animals are confined in the animal feeding operation."
  1 15    #3.  Page 1, by striking lines 27 through 36, and
  1 16 inserting the following:
  1 17    "NEW SUBSECTION.  33A.  "Runoff control basin"
  1 18 means an impoundment designed and operated to collect
  1 19 and store runoff from an open feedlot."
  1 20    #4.  By striking page 1, line 37 through page 2,
  1 21 line 10, and inserting the following:
  1 22    "Sec. ___.  NEW SECTION.  455B.205A  CONSTRUCTION
  1 23 DESIGN STANDARDS – OPEN FEEDLOT RUNOFF CONTROL
  1 24 BASINS.
  1 25    If the department requires an open feedlot runoff
  1 26 control basin receiving runoff from which solids have
  1 27 been settled in accordance with requirements provided
  1 28 in 567 IAC 65.2(1) to be constructed according to
  1 29 design standards, regardless of whether the department
  1 30 requires the owner to obtain a construction permit
  1 31 under section 455B.200, design standards for the basin
  1 32 shall be established by rule as provided in chapter
  1 33 17A that exclusively account for special design
  1 34 characteristics of open feedlots and related runoff
  1 35 control basins, including but not limited to the
  1 36 dilute composition of settled open feedlot effluent as
  1 37 collected and stored in runoff control basins.""
