  1  1    Amend the amendment, H-8206, to Senate File 348, as
  1  2 amended, passed, and reprinted by the Senate, as
  1  3 follows:
  1  4    #1.  Page 2, line 28, by inserting after the word
  1  5 "received." the following:  "An application approved
  1  6 by a school board and subsequently approved by the
  1  7 state board pursuant to subsection 6 shall constitute,
  1  8 at a minimum, an agreement between the school board
  1  9 and the charter school for the operation of the
  1 10 charter school."
  1 11    #2.  Page 2, line 41, by striking the word "or" and
  1 12 inserting the following:  "and".
  1 13    #3.  Page 3, line 1, by striking the word and
  1 14 figure "section 256F.4" and inserting the following:
  1 15 "sections 256F.4 and 256F.5.  The state board may deny
  1 16 an application if the state board deems that approval
  1 17 of the application is not in the best interest of the
  1 18 affected students".
  1 19    #4.  Page 3, line 2, by inserting after the word
  1 20 "applications." the following:  "The state board shall
  1 21 approve not more than one charter school application
  1 22 per school district."
  1 23    #5.  Page 3, by striking lines 19 through 27 and
  1 24 inserting the following:  "location, and its projected
  1 25 enrollment."
  1 26    #6.  Page 4, line 34, by inserting after the word
  1 27 "eligible" the following:  "resident".
  1 28    #7.  Page 4, by striking lines 38 through 41 and
  1 29 inserting the following:  "case, students must be
  1 30 accepted by lot.  A charter school may enroll an
  1 31 eligible nonresident student who submits a timely
  1 32 application in accordance with the student admission
  1 33 policy established pursuant to section 256F.5,
  1 34 subsection 1.  If the charter school enrolls an
  1 35 eligible nonresident student, the charter school shall
  1 36 notify the school district and the sending district
  1 37 not later than March 1 of the preceding school year.
  1 38 Transportation for the student shall be in accordance
  1 39 with section 282.18, subsection 10.  The sending
  1 40 district shall make payments to the charter school in
  1 41 the manner required under section 282.18, subsection
  1 42 7."
  1 43    #8.  Page 5, lines 3 and 4, by striking the words
  1 44 "and issue bonds".
  1 45    #9.  Page 5, line 26, by inserting after the word
  1 46 "school" the following:  "including, at a minimum, a
  1 47 listing of the support services the school district
  1 48 will provide, and the charter school's revenues,
  1 49 budgets, and expenditures".
  1 50    #10.  Page 6, line 4, by inserting after the word
  2  1 "shall" the following:  ", at a minimum,".
  2  2    #11.  Page 6, line 5, by inserting after the word
  2  3 "four-year" the following:  "enforceable,".
  2  4    #12.  Page 6, by striking line 7 and inserting the
  2  5 following:  "shall include an operating agreement for
  2  6 the operation".
  2  7    #13.  Page 8, by striking lines 3 through 5 and
  2  8 inserting the following:  "who attended the school,
  2  9 and any siblings of the student, shall be determined
  2 10 to have shown good cause".
  2 11    #14.  Page 9, by inserting after line 37, the
  2 12 following:
  2 13    "Sec.    .  CONDITIONAL EFFECTIVENESS.  This Act
  2 14 takes effect upon the department of education's
  2 15 receipt of federal funds that are provided to the
  2 16 department under Pub. L. No. 107-110, cited as the
  2 17 federal No Child Left Behind Act of 2001 (Title V,
  2 18 Part B), for purposes of providing financial
  2 19 assistance for the planning, program design, and
  2 20 initial implementation of public charter schools.  The
  2 21 department of education shall notify the Code editor
  2 22 upon receipt of such federal funds.""
