1 1 Amend the amendment, H-8299, to Senate File 2190,
1 2 as amended, passed, and reprinted by the Senate, as
1 3 follows:
1 4 #1. Page 1, by inserting after line 44 the
1 5 following:
1 6 "# . Page 3, by inserting after line 6 the
1 7 following:
1 8 "Sec. . Section 86.13, unnumbered paragraph 4,
1 9 Code 2001, is amended by striking the unnumbered
1 10 paragraph and inserting in lieu thereof the following:
1 11 Unless the employer proves as an affirmative
1 12 defense that the employer had a reasonable excuse for
1 13 not paying or for paying amounts after their due dates
1 14 fixed by law or by a health care provider, including
1 15 all benefits provided by sections 85.27 through 85.34
1 16 or section 86.13, whether constituting compensation,
1 17 interest, penalties, or other benefits, the denial or
1 18 delay of which payment is proven by the employee, the
1 19 workers' compensation commissioner shall order the
1 20 employer to pay the employee a penalty equal to treble
1 21 the amount or the value, as the case may be, of the
1 22 payment which was denied or delayed past the due
1 23 date.""
