1 1 Amend the amendment, H-8299, to Senate File 2190,
1 2 as amended, passed, and reprinted by the Senate, as
1 3 follows:
1 4 #1. Page 1, by inserting after line 44 the
1 5 following:
1 6 "# . Page 3, by inserting after line 6 the
1 7 following:
1 8 "Sec. . Section 86.13, unnumbered paragraph 4,
1 9 Code 2001, is amended by striking the unnumbered
1 10 paragraph and inserting in lieu thereof the following:
1 11 Unless the employer proves as an affirmative
1 12 defense that the employer had a reasonable excuse for
1 13 not paying or for paying weekly compensation after its
1 14 due date, the denial or delay of which is proven by
1 15 the employee, the workers' compensation commissioner
1 16 shall order the employer to pay the employee a penalty
1 17 equal to treble the amount of the weekly compensation,
1 18 the payment of which was denied or delayed past the
1 19 due date.""
