1 1 Amend Senate File 2190, as amended, passed, and
1 2 reprinted by the Senate, as follows:
1 3 #1. Page 3, by inserting after line 6 the
1 4 following:
1 5 "Sec. . Section 86.13, unnumbered paragraph 4,
1 6 Code 2001, is amended by striking the unnumbered
1 7 paragraph and inserting in lieu thereof the following:
1 8 Unless the employer proves as an affirmative
1 9 defense that the employer had a reasonable excuse for
1 10 not paying or for paying weekly compensation after its
1 11 due date, the denial or delay of which is proven by
1 12 the employee, the workers' compensation commissioner
1 13 shall order the employer to pay the employee a penalty
1 14 equal to treble the amount of the weekly compensation,
1 15 the payment of which was denied or delayed past the
1 16 due date."
