1 1 Amend Senate File 2190, as amended, passed, and
1 2 reprinted by the Senate, as follows:
1 3 #1. Page 3, by inserting after line 6 the
1 4 following:
1 5 "Sec. . Section 86.13, unnumbered paragraph 4,
1 6 Code 2001, is amended by striking the unnumbered
1 7 paragraph and inserting in lieu thereof the following:
1 8 Unless the employer proves as an affirmative
1 9 defense that the employer had a reasonable excuse for
1 10 not paying or for paying amounts after their due dates
1 11 fixed by law or by a health care provider, including
1 12 all benefits provided by sections 85.27 through 85.34
1 13 or section 86.13, whether constituting compensation,
1 14 interest, penalties, or other benefits, the denial or
1 15 delay of which payment is proven by the employee, the
1 16 workers' compensation commissioner shall order the
1 17 employer to pay the employee a penalty equal to treble
1 18 the amount or the value, as the case may be, of the
1 19 payment which was denied or delayed past the due
1 20 date."
