  1  1    Amend Senate File 2267, as amended, passed, and
  1  2 reprinted by the Senate, as follows:
  1  3    #1.  Page 1, by inserting before line 1 the
  1  4 following:
  1  5    "Section 1.  Section 602.1205, Code 2001, is
  1  6 amended by adding the following new subsection:
  1  7    NEW SUBSECTION.  3.  A clerk of the district court
  1  8 shall be maintained in each county at the county seat.
  1  9    Sec. 2.  Section 602.1215, subsection 1, Code 2001,
  1 10 is amended to read as follows:
  1 11    1.  The district judges of each judicial election
  1 12 district shall by majority vote appoint persons to
  1 13 serve as clerks of the district court, one for each
  1 14 county within the judicial election district as
  1 15 required by section 602.1205, subsection 3.  A person
  1 16 does not qualify for appointment to the office of
  1 17 clerk of the district court unless the person is at
  1 18 the time of application a resident of the state.
  1 19 Within three months of appointment the clerk of the
  1 20 district court must establish residence and physically
  1 21 reside in the county.  A clerk of the district court
  1 22 may be removed from office for cause by a majority
  1 23 vote of the district judges of the judicial election
  1 24 district.  Before removal, the clerk of the district
  1 25 court shall be notified of the cause for removal."
  1 26    #2.  Page 2, by inserting after line 11 the
  1 27 following:
  1 28    "Sec.    .  Section 602.6108, Code 2001, is amended
  1 29 to read as follows:
  1 30    602.6108  REASSIGNMENT OF PERSONNEL.
  1 31    The chief justice of the supreme court shall assign
  1 32 judicial officers and court employees from one
  1 33 judicial district to another, except for the clerk of
  1 34 the district court, on a continuing basis if need be,
  1 35 in order to handle the judicial business in all
  1 36 districts promptly and efficiently at all times."
  1 37    #3.  Page 2, by inserting after line 24 the
  1 38 following:
  1 39    "Sec.    .  Section 602.8102, subsection 1, Code
  1 40 Supplement 2001, is amended to read as follows:
  1 41    1.  Keep the office of the clerk at the county seat
  1 42 as required by section 602.1205, subsection 3.
  1 43    Sec.    .  REPEAL.  The sections of this Act
  1 44 amending sections 602.1205, 602.1215, 602.6108, and
  1 45 602.8102 are repealed upon the division of the state
  1 46 into judicial districts and judicial election
  1 47 districts pursuant to section 602.6107."
  1 48    #4.  Title page, line 1, by striking the words
  1 49 "districts and" and inserting the following:
  1 50 "districts,".
  2  1    #5.  Title page, line 2, by inserting after the
  2  2 word "districts" the following:  ", and clerks of
  2  3 court offices".
  2  4    #6.  By renumbering as necessary.
