PAG LIN 1 1 Amend House File 2430 as follows: 1 2 #1. By striking page 1, line 1 through page 2, 1 3 line 25 and inserting the following: 1 4 "Section 1. Section 225C.5, subsection 1, Code 1 5 2001, is amended to read as follows: 1 6 1. A mental health and developmental disabilities 1 7 commission is created as the state policy-making body 1 8 for the provision of services to persons with mental 1 9 illness, mental retardation or other developmental 1 10 disabilities, or brain injury. The commission shall 1 11 consist offifteensixteen voting members appointed to 1 12 three-year staggered terms by the governor and subject 1 13 to confirmation by the senate. Commission members 1 14 shall be appointed on the basis of interest and 1 15 experience in the fields of mental health, mental 1 16 retardation or other developmental disabilities, and 1 17 brain injury, in a mannerso that, if possible, the1 18composition of the commission will comply with the1 19requirements of the Community Mental Health Centers1 20Amendments of 1975, 42 U.S.C. } 2689t(a) (1976)1 21relative to a state mental health advisory council,1 22andso as to ensure adequate representation from 1 23 persons with disabilities and individuals 1 24 knowledgeable concerning disability services. The 1 25 department shall provide staff support to the 1 26 commission, and the commission may utilize staff 1 27 support and other assistance provided to the 1 28 commission by other persons. Members of the 1 29 commission shall include the following persons who, at 1 30 the time of appointment to the commission, are active 1 31 members of the indicated groups: 1 32 a.FourThree members shall be members of a county 1 33 board of supervisors selected from nominees submitted 1 34 by the county supervisor affiliate of the Iowa state 1 35 association of counties. 1 36 b. Two members shall bemembers of a mental health1 37and developmental disabilities regional planning1 38councilselected from nominees submitted by the 1 39 director. 1 40 c. One member shall beeitheran active board 1 41 member of a community mental health centeror of a1 42statewide association of persons with mental illness1 43or of family members of persons with mental illness. 1 44 d. One member shall be either an active board 1 45 member of an agency serving persons withmental1 46retardation or of a statewide association for persons1 47with mental retardationa developmental disability 1 48 selected from nominees submitted by the association of 1 49 community providers. 1 50 e. One member shall bean active member of a2 1statewide organization for persons witha board member 2 2 or employee of a provider of mental health or 2 3 developmental disabilitiesother than mental2 4retardationservices to children. 2 5f. One member shall be an active member of a2 6statewide organization for persons with brain injury.2 7 f. Two members shall be administrators of the 2 8 single entry point process established in accordance 2 9 with section 331.440 selected from nominees submitted 2 10 by the community services affiliate of the Iowa state 2 11 association of counties. 2 12 g. One member shall be selected from nominees 2 13 submitted by the state's council of the association of 2 14 federal, state, county, and municipal employees. 2 15 h. Three members shall be service consumers or 2 16 family members of service consumers with at least one 2 17 member who is a parent of a child service consumer. 2 18 i. Two members shall be selected from nominees 2 19 submitted by service advocates. 2 20 j. In addition to the voting members, the 2 21 membership shall include four members of the general 2 22 assembly with one member designated by each of the 2 23 following: the majority leader of the senate, the 2 24 minority leader of the senate, the speaker of the 2 25 house of representatives, and the minority leader of 2 26 the house of representatives. A legislative member 2 27 serves in an ex officio, nonvoting capacity and is 2 28 eligible for per diem and expenses as provided in 2 29 section 2.10. 2 30 Sec. . Section 225C.6, subsection 1, Code 2 31 Supplement 2001, is amended by adding the following 2 32 new paragraph: 2 33 NEW PARAGRAPH. q. Perform analyses and other 2 34 functions associated with a redesign of the mental 2 35 health and developmental disability services systems 2 36 for adults and for children." 2 37 #2. Page 4, by striking lines 1 through 4 and 2 38 inserting the following: "department's actions under 2 39 this subsection. The department shall consult with 2 40 thestate-county management committeemental health 2 41 and developmental disabilities commission in adopting 2 42 rules for oversight of facilities". 2 43 #3. Page 9, line 10, by striking the words "The 2 44 basis for determining whether a" and inserting the 2 45 following: "The basis for determining whether aA". 2 46 #4. Page 9, by striking lines 11 through 13 and 2 47 inserting the following: "mental health proposed by a 2 48 countyis comparable to a mental health managed care2 49contractor approved by the department of human2 50servicesshall include but is not limited to all of 3 1 the". 3 2 #5. Page 9, by striking lines 29 and 30 and 3 3 inserting the following: "county managed system of 3 4 careand the state-approved managed care contract or3 5contractsshall be specified in rules developed by". 3 6 #6. Page 11, line 17, by striking the words "or 3 7 employed by a service provider". 3 8 #7. Page 12, line 16, by inserting after the word 3 9 "occur." the following: "The initial term of one of 3 10 the members appointed during the fiscal year beginning 3 11 July 1, 2002, shall be two years." 3 12 #8.
